Deffects declaration of nullity of the contract
Abstract
The declaration of nullity is a sanction by which the legal act is deprived of its normal effects when, in its execution, the prescribed forms have not been observed. Therefore, for the null act requires a judicial ruling that seeks to avoid its effects. The main purpose of the declaration is that a null or flawed contract does not produce effects and once the context is determined, those already produced disappear. The scope generated by the effects of the declaration of nullity of a contract can also restore the benefits as making the obligation constituted in default unenforceable
