The «Obvious» Nullity of the Marriage Resolved by the Judge in Family Procedural Law

Abstract

The autor invites us to reflect on an institution emerged in civil law and provided for in article 275 of the civil code, the «notorious» nullity of the marriage warned ex officio and resolved by the Judge in a process. In a didactic way, through a particular case, it introduces us to the judicial problem. There is no doubt that the topic is current, being useful for anyone who approaches family procedural law.
